Embargoed Goods and Prohibited Countries Policy

If you intend to sell on one or more of eBay's international sites, you will need to accept, and we encourage you to carefully review, the User Agreement, policies, and other requirements of that site. You can continue to reach out to the relevant customer service teams on the respective eBay site of your listing or transaction, as may be applicable to the nature of your query.

The sale of certain types of items is prohibited. Further, sale to particular countries is also prohibited under Indian Law. You are required to adhere to the provisions of applicable statutes at the time of transacting on eBay India.

eBay India has also decided to adopt the “Embargoed goods and prohibited countries” policy of eBay.com with regard to embargoed goods and trade with prohibited countries to the extent that the said policy [of eBay.com] is not inconsistent with the aforementioned requirement under Indian Law. You should examine the applicability of the policy under India Law and the “Embargoed goods and prohibited countries” policy of eBay.com and as applicable for other countries with which you choose to conduct transaction(s) for sale/purchase of goods or provision/receipt of services.

Please note that:

  • Various US agencies have sanctions in place that substantially regulate or ban all trade with particular countries, including - Cuba, Iran, Democratic People’s Republic of Korea, and Syria). eBay doesn’t allow the sale of embargoed (restricted) items from those countries. 

  • US Federal agencies have also banned or regulated trade between US persons and certain organisations, businesses and individuals. eBay does not allow those organisations, businesses or individuals to use our service.

  • Buyers and sellers listing/ shipping/ trading internationally should periodically review current information about which countries may be affected by sanctions enforced by Indian Customs and/or the Office of Foreign Assets Control of the US Department of the Treasury. See Additional Information below for more details about laws governing such trades.

Violations of this policy may result in a range of actions, including the following.

  • Listing cancellation

  • Limits on account privileges

  • Account suspension

  • Forfeit of eBay fees on cancelled listings

  • Loss of PowerSeller status

  • Referral to Law Enforcement

In addition to the above actions, eBay may at its discretion:

  • Report such listing(s) and/or transaction(s) to statutory agencies including law enforcement

  • Take down/remove such listings

  • Initiate legal proceedings against the User(s)

Why does eBay have this policy?

eBay urges its sellers and buyers to comply with all governmental laws and regulations. Since the sale of embargoed items are prohibited under United States law and sale of certain items are prohibited to certain countries under Indian law, sellers may not list them on eBay.

eBay India reserves the right to modify, alter or change this policy at any time without notice or assigning any reasons for the same.
